TENANTS OF 230 WEST 55TH STREET
PETITION FOR DECREASED CONSTRUCTION HOURS OR RENT ABATEMENT
TO: DOUGLAS ELLIMAN PROPERTY MANAGEMENT
FROM: TENANTS OF 230 WEST 55TH STREET
SUBJECT: PETITION FOR RELIEF
DATE: 1/17/2012
CC: PROPERTY OWNER - HARRY GROSS
Please find attached the petition, drafted and signed by tenants of
230 West 55th St, seeking either a reduction in construction hours or
rent abatement.
Many tenants along the F and G lines have already vacated the premises
due to the untenable noise, 24 hour floodlights, and boarded over
windows. Understandably, rental values of these units has dropped
significantly, as evidenced by the current rates advertised for the
vacant units, and the length of time these units are sitting on the
market.
Despite the severely impacted quality of life for tenants on the F and
G lines, and the consequently decreased market value of these units,
remaining tenants are being offered lease extensions with hefty rent
increases. This is both unreasonable and impractical for all
parties.
After months of deafening silence from Property Management and the
Owner, the memo released yesterday makes it clear that construction
hours will not be reduced. Therefore, the tenants of the F and G
lines of 23O West 55th St seek rent abatement as outlined in the
petition. The amount of this abatement should reflect both the
severely diminished habitability, and the current market value, of
these units. In addition, we ask that it be retroactive to the
beginning of the current phase of construction, which began in
October, 2011.
Thank you for your consideration and cooperation.
